These Terms of Use ("Terms") govern your access to and use of the SmartOnlineExam website at www.smartonlineexam.com and its Android application ("Platform"), operated by SmartOnlineExam. By creating an account, purchasing a course, or using any feature of our Platform, you confirm that you have read, understood, and agreed to these Terms.

Acceptance of Terms

By accessing or using SmartOnlineExam, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Platform.

We reserve the right to update these Terms at any time. Continued use of the Platform after changes are published constitutes acceptance of the revised Terms.

Eligibility

To use SmartOnlineExam, you must:

Be at least 16 years of age (or the minimum age required to appear for Railway examinations in India)
Be a resident or citizen of India, or otherwise able to access our Platform under applicable laws
Not have been previously suspended or removed from our Platform
Have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872

Account Registration

To access most features of SmartOnlineExam, you must create an account. When registering, you agree to:

Provide accurate, current, and complete information (name, email, mobile number)
Maintain the security of your password and not share it with others
Notify us immediately at support@smartonlineexam.com of any unauthorised access to your account
Take responsibility for all activity that occurs under your account

Each registered account is for the use of a single individual only. Sharing your login credentials with others to allow access to paid courses is a violation of these Terms and may result in immediate account termination without refund.

Course Access & Licence

4.1 Licence Granted

Upon purchasing a course or test series, SmartOnlineExam grants you a limited, non-exclusive, non-transferable, personal licence to access and use the course content solely for your own personal, non-commercial educational purposes — specifically to prepare for Railway Psycho Tests (CBAT).

4.2 Access Period

Course access validity is as specified at the time of purchase. Upon expiry, access to that course is discontinued unless you renew. SmartOnlineExam is not liable for exam results or selection outcomes related to any access period.

4.3 Technical Requirements

You are responsible for ensuring your device meets the minimum requirements to use the Platform (internet connection, compatible browser or the Android app). SmartOnlineExam is not responsible for access issues caused by your device, internet connection, or browser.

4.4 Content Updates

We update course content regularly to align with the latest RDSO CBAT patterns and exam notifications. While we strive for accuracy, SmartOnlineExam does not guarantee that all content is free from errors at all times.

Intellectual Property

All content on SmartOnlineExam — including but not limited to mock tests, questions, T-Score calculation methodology, video solutions, written explanations, images, graphics, UI design, and branding — is the exclusive intellectual property of SmartOnlineExam and is protected under:

The Copyright Act, 1957 (India)
The Information Technology Act, 2000 (India)
Applicable international intellectual property laws

⛔ You may not copy, reproduce, distribute, publish, share, upload, transmit, sell, sublicense, or create derivative works from any SmartOnlineExam content without explicit written permission. This includes sharing screenshots of test questions, copying questions to other platforms, or reselling course access.

Prohibited Conduct

You agree not to:

Share your account credentials or provide access to paid content to any other person
Use automated bots, scripts, or scraping tools to access Platform content
Reverse-engineer, decompile, or attempt to extract the source code or question database
Post, upload, or transmit defamatory, offensive, or unlawful content
Impersonate SmartOnlineExam, its employees, or other users
Use the Platform for any commercial purpose without written consent
Interfere with or disrupt Platform servers, networks, or security
Circumvent any content protection or access restriction measures
Use the Platform in any way that violates applicable Indian laws or regulations

Violation of any prohibited conduct may result in immediate account suspension or termination, forfeiture of any paid access, and legal action where applicable.

Payments & Billing

7.1 Pricing

All prices are displayed in Indian Rupees (INR) and include applicable GST unless stated otherwise. Prices may change at any time; existing purchases are not affected.

7.2 Payment Processing

Payments are processed through third-party gateways (Razorpay, PayU, or similar). SmartOnlineExam does not store your complete card or UPI details. By making a payment, you agree to the payment gateway's terms as well.

7.3 Failed Transactions

If payment is deducted but course access is not activated, contact us at support@smartonlineexam.com with your transaction ID within 48 hours. We will investigate and resolve the issue promptly.

Disclaimers

⚠️ No Guarantee of Selection: SmartOnlineExam provides preparation tools and mock tests. We do not guarantee that use of our Platform will result in you passing the Railway Psycho Test or being selected for any Railway post. Selection outcomes depend on official RDSO evaluation, individual performance, and factors beyond our control.

The Platform is provided on an "as is" and "as available" basis. To the extent permitted by law, SmartOnlineExam makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that: (a) the Platform will be uninterrupted or error-free; (b) content is always accurate or current; (c) results obtained from using the Platform will meet your expectations.

Limitation of Liability

To the maximum extent permitted by applicable law, SmartOnlineExam and its founders, employees, and affiliates shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, business, or goodwill
Damages resulting from inability to access the Platform due to technical issues or scheduled maintenance
Any exam result, selection outcome, or career decision based on Platform content

In all cases, our maximum liability to you shall not exceed the amount you paid to SmartOnlineExam in the 3 months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless SmartOnlineExam, its founders, employees, agents, and affiliates from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of your: (a) violation of these Terms; (b) misuse of the Platform; (c) infringement of any third-party rights; or (d) violation of any applicable law.

Modifications to the Platform

SmartOnlineExam reserves the right to modify, suspend, or discontinue any part of the Platform at any time with or without notice. We may also modify the structure, content, or features of courses. We will make reasonable efforts to notify users of significant changes that affect paid course access.

Termination

SmartOnlineExam may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination:

Your right to access the Platform and all course content ceases immediately
Paid course access will be forfeited without refund if termination is due to a breach
Provisions of these Terms that by their nature should survive termination will continue to apply

You may delete your account at any time by contacting us at support@smartonlineexam.com.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of India. Any disputes arising from or in connection with these Terms or your use of SmartOnlineExam shall be:

First attempted to be resolved through good-faith negotiation between the parties
If unresolved within 30 days, subject to the exclusive jurisdiction of the competent courts of India

The Consumer Protection Act, 2019 (India) and the Information Technology Act, 2000 apply where relevant.

Welcome to Smart Online Exam ("Platform", "we", "us", or "our"). By accessing or using our Platform, you agree to be bound by these Terms of Use ("Terms"). Please read these Terms carefully. If you do not agree with any of these terms, you are prohibited from using or accessing this Platform.

1. ACCEPTANCE OF TERMS

By accessing this Platform, you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. USE LICENSE

Permission is granted to temporarily access the materials (information, software, products, or services) on Smart Online Exam's Platform for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

Modify or copy the materials;
Use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
Attempt to decompile or reverse engineer any software contained on the Platform;
Remove any copyright or other proprietary notations from the materials; or
Transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Smart Online Exam at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. USER ACCOUNTS

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Platform.

You are responsible for safeguarding the password that you use to access the Platform and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. CONTENT

Our Platform allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material. You are responsible for the content that you post on or through the Platform, including its legality, reliability, and appropriateness.

By posting content on or through the Platform, you represent and warrant that: (i) the content is yours and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your content on or through the Platform does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

5. INTELLECTUAL PROPERTY

The Platform and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Smart Online Exam and its licensors. The Platform is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Smart Online Exam.

6. LINKS TO OTHER WEBSITES

Our Platform may contain links to third-party websites or services that are not owned or controlled by Smart Online Exam.

Smart Online Exam has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Smart Online Exam shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

7. TERMINATION

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform.

8. LIMITATION OF LIABILITY

In no event shall Smart Online Exam, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any content obtained from the Platform; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of the country where Smart Online Exam is headquartered, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Platform.
